These Terms of Service constitute a legally binding agreement between you and Flint Connect, governing your access and use of our virtual private network (VPN) services, software applications, and related websites (collectively, "Services"). By accessing, installing, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with all of these Terms of Service, you are expressly prohibited from using the Services and must discontinue use immediately.
1. Agreement to Terms
By using Flint Connect's Services, you confirm your acceptance of these Terms and agree to comply with them. You also represent that you are at least 18 years of age or possess legal parental or guardian consent, and are fully able and competent to enter into these terms, conditions, obligations, affirmations, representations, and warranties, and to abide by and comply with these Terms of Service.
2. Account & Subscription
2.1 Account Creation
To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for any activities or actions under your account.
2.2 Subscriptions and Automatic Renewals
Flint Connect offers various subscription plans for its VPN services. Subscriptions are billed on a recurring basis (e.g., monthly, annually) as selected by you. Unless you cancel your subscription before the end of the current billing cycle, your subscription will automatically renew, and you authorize us to charge your payment method for the next subscription period. You acknowledge that if you make a recurring payment via an external service, such as a mobile app store, the subscription will renew in accordance with the terms of that service provider.
2.3 Cancellation Policy
You can cancel your Flint Connect subscription at any time through your account settings or by contacting our support team. Cancellation will take effect at the end of your current billing period, and you will retain access to the Services until that time. No pro-rata refunds are issued for partial subscription periods. For subscriptions made via app stores, cancellations must be handled directly through the respective app store's subscription management.
3. Refund Policy
Flint Connect offers a 30-day money-back guarantee for all new subscriptions. If you are not entirely satisfied with our VPN service within the first 30 days of your initial purchase, you may request a full refund. This guarantee applies only to direct purchases made on our official website. Purchases made through third-party resellers or app stores are subject to their respective refund policies. After the initial 30 days, all sales are final, and no refunds will be issued.
4. Acceptable Use Policy
You agree not to use Flint Connect Services for any illegal, abusive, or irresponsible activities, including but not limited to:
- Engaging in any form of hacking, phishing, spamming, denial-of-service (DoS) attacks, or distribution of malware.
- Distributing, infringing upon, or violating third-party intellectual property rights, trademarks, or copyrights.
- Transmitting any material that is unlawful, harmful, threatening, abusive, libelous, or obscene.
- Attempting to gain unauthorized access to any system, network, or data.
- Using the Services to facilitate or engage in any criminal activity or violation of applicable laws and regulations.
- Sharing your account credentials with others or reselling the Service without explicit authorization.
Violation of this Acceptable Use Policy may result in immediate termination of your service without refund.
5. Service Guarantees & Limitations
5.1 Service Uptime
While Flint Connect strives for 99.9% uptime and reliable service, we do not guarantee uninterrupted access to our Services. Occasional interruptions may occur for maintenance, upgrades, or factors beyond our control. We will endeavor to provide notice of scheduled maintenance.
5.2 Performance and Speed
The speed and performance of the VPN service can vary based on factors such as location, server load, internet connection speed, and network configuration. Flint Connect does not guarantee specific speeds or performance levels. Some content providers may also block or throttle VPN connections, which is beyond our control.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Flint Connect, its affiliates, directors, employees, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with the use of, or inability to use, the Service. In no event will Flint Connect's total liability to you for all damages, losses, and causes of action exceed the amount paid by you to Flint Connect for the Services in the twelve (12) months preceding the claim. This limitation of liability does not attempt to exclude liability or limit liability for gross negligence, fraud, or intentional misconduct, or any other liability which cannot be excluded or limited under applicable law.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in Austin, Texas, for any actions for which we retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction.
8. Changes to Terms
Flint Connect reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
